Terms and Conditions

(“Sale Agreement”)

By making a purchase, placing an order, or otherwise shopping on this website, the customer (“Customer,” “you,” or “your”) agrees to these Terms & Conditions. If you have signed a separate formal purchase agreement with TransMed Co, LLC (“TransMed,” “we,” “us,” or “our”), that separate agreement shall govern.

1. Agreement and Acceptance

This Sale Agreement is a legal contract between the Customer and TransMed Co, LLC, the company operating UScreenTests.com. It constitutes the entire agreement relating to the purchase or sale of products and services through this website, except where a separate signed purchase agreement applies.

These terms may change without prior notice. However, the terms posted on the website when you initially place or modify an order will govern that order. Any modification or termination of this Sale Agreement relating to products or services already purchased must be in writing and signed by TransMed.

2. Products and Intended Use

Our products and services include drug and alcohol testing products and related services, including pre-employment screening products and services for the workplace.

Our drug testing products provide preliminary, qualitative results only. For a more specific and accurate result, we recommend confirmation by gas chromatography/mass spectrometry (GC/MS) through a SAMHSA-certified laboratory.

3. Website Information and Pricing

We use reasonable efforts to maintain accurate and complete information on this website. However, we do not guarantee or warrant the accuracy, completeness, or currency of its content, including product descriptions, pricing, advertisements, and offers.

All pricing is subject to change. TransMed reserves the right to make adjustments due to changing market conditions, product discontinuation, manufacturer price changes, advertising errors, and other extenuating circumstances, subject to the terms governing an existing order under Section 1.

Website content may become outdated, and TransMed is under no obligation to update it. To the maximum extent permitted by applicable law, we assume no liability for errors or omissions in website content.

High-volume pricing inquiries are welcome.

4. Payment Terms

Unless otherwise specified on the invoice, payment is required in advance. Time is of the essence with respect to payment obligations.

Subject to any separate signed purchase agreement, these terms and the terms stated on the seller’s invoice take precedence over conflicting terms in the Customer’s purchase order.

Accounts with delinquent balances under the specified payment terms are subject to collection agency fees equal to 20% of the outstanding balance, to the extent permitted by applicable law.

5. Risk of Loss During Shipping

Loss or damage occurring during shipment by a carrier selected by TransMed is TransMed’s responsibility. Loss or damage occurring during shipment by a carrier selected by the Customer is the Customer’s responsibility.

6. Disclaimer of Warranties

To the maximum extent permitted by applicable law, TransMed expressly disclaims all warranties, whether express or implied, including warranties of merchantability or fitness for a particular purpose, with respect to its products, services, and website content.

7. Limitation of Liability for Products and Services

To the maximum extent permitted by applicable law, TransMed will not be liable for lost profits, loss of business, or consequential, special, indirect, or punitive damages, even if advised of the possibility of such damages. TransMed will not be liable for claims by third parties except as expressly provided in this Sale Agreement, or for products or services being unavailable for use.

TransMed’s total liability relating to the purchase of products or services under this Sale Agreement shall not exceed the aggregate amount paid by the Customer for the purchases under this Sale Agreement.

8. Website Use and Third-Party Links

To the maximum extent permitted by applicable law, TransMed, its affiliated companies, parties involved in creating, producing, maintaining, or delivering this website, and their respective officers, directors, employees, shareholders, and agents disclaim liability for losses or damages arising from:

  • Accessing, using, or being unable to use this website.

  • Accessing or using websites linked from this website or relying on their content.
  • Viruses that may infect computer equipment, software, data, or other property through browsing this website or downloading material from this website or linked websites.

This disclaimer includes direct, indirect, punitive, and consequential losses or damages, including loss of income, profits, goodwill, data, contracts, use of money, or losses arising from business interruption, whether based on tort, including negligence, contract, or any other legal theory.

9. Governing Law and Jurisdiction

The Customer consents to the jurisdiction of the state courts located in Forsyth County, Georgia, and the federal courts having jurisdiction over Forsyth County, Georgia, for any suit, action, or proceeding arising out of this Sale Agreement.
